Threat to Public Safety’: Gujarat HC Takes Suo Motu Cognizance of Rajkot Gaming Zone Fire That Killed 27
A special bench comprising Justices Biren Vaishnav and Devan Desai convened on Sunday morning, requesting a report from the state government and municipal corporations to clarify under which legal provisions such gaming zones and recreational facilities were permitted to operate.
This action followed a tragic incident where a fire at a private amusement park/gaming zone in Rajkot resulted in the deaths of at least 27 people, including children. In response, the Gujarat High Court took suo motu cognizance of the incident.
The bench, citing news reports, noted that the Rajkot gaming zone seemed to exploit loopholes in the Gujarat Comprehensive General Development Control Regulations (GDCR) to facilitate illegal recreational activities. The bench expressed its shock, calling the incident a "man-made disaster."
The court highlighted that these entertainment zones appeared to be operating without necessary approvals from the relevant authorities. Reports indicated that to bypass permissions and NOCs, including fire safety clearances, temporary structures like tin sheds were erected. The bench also took note of similar gaming zones in Ahmedabad, which posed significant public safety risks. Furthermore, it was reported that the Rajkot gaming zone stored highly flammable materials, such as petrol, tires, and fiberglass sheets.
The court directed the registry to file a suo motu public interest litigation regarding the incident, scheduling the next hearing for May 27. In the meantime, the bench instructed a panel of advocates to appear on Monday with information on the legal basis for allowing these gaming zones and recreational facilities to operate.
The bench also requested the state and corporations to detail the licensing process, including fire safety compliance, for these entertainment zones.
Additionally, advocate Amit Panchal submitted an application concerning the fire, urging the court to demand an immediate explanation from the state and its authorities on how the TRP gaming zone was allowed to operate without the necessary permissions and licenses.
