Key Points

1. New Income Requirement in Denmark: Starting June 30, 2024, Denmark will enforce a new income requirement for foreigners applying for residence and work permits.
2. Alignment with Danish Salary Standards: The updated requirement ensures that foreign workers' salaries match Danish standards. Applications will be assessed using salary statistics from the first quarter of 2024.
3. Application Refusals Based on Salary: Foreigners whose salaries do not meet Danish standards will have their applications for residence and work permits denied.

Denmark will introduce a new income requirement for foreigners applying for residence and work permits, effective from June 30, 2024. This new criterion is part of updated salary statistics intended to ensure that foreign workers receive salaries that align with Danish standards.

According to the Danish Agency for International Recruitment and Integration (SIRI), applications filed after June 30, 2024, will be evaluated based on the salary statistics for the first quarter of 2024. In contrast, applications submitted between April 1, 2024, and June 30, 2024, will be assessed using the previous salary statistics.

Ensuring Salary Standards for Foreign Workers

To be granted a residence and work permit, a foreigner’s salary must align with Danish standards. This requirement applies to both initial applications and extensions of existing permits.

SIRI emphasizes that the salary must match the standards for the specific type of employment in Denmark. This requirement applies to foreigners applying under various schemes, including:

- Fast Track Scheme
- Herdsmen and Farm Managers Scheme
- Internship Scheme
- Pay Limit Scheme
- Positive List for People With Higher Education
- Positive List for Skilled Workers
- Researcher’s Scheme
- Special Individual Qualifications Scheme
- Supplementary Pay Limit Scheme

Generally, SIRI assumes that the salaries offered to foreigners meet Danish standards. However, if there are concerns that a salary does not comply with these standards, SIRI may request a comment from the employer before making a decision on the application.
