Netherlands Closes Popular Restaurant Amid Work Permit Fraud Allegations

Key Takeaways

1. The Labour Inspectorate has shut down the Chinese restaurant Fat Kee in The Hague following allegations of work permit falsification.
2. The restaurant had previously been fined nearly €16,000 for similar offenses.
3. The Labour Inspectorate found employees working outside the terms of their work permits at the restaurant.

The Chinese restaurant Fat Kee in The Hague has been temporarily closed for a month due to allegations of falsifying work permits for its employees. The Labour Inspectorate took action after finding employees performing tasks not authorized by their permits. This comes after the restaurant had already faced fines of nearly €16,000 for similar violations in the past.

In its latest inspection, the Labour Inspectorate discovered that the restaurant’s administration had failed to comply with regulations, and employees were found working without the proper permits. Additionally, the restaurant had refused to provide necessary identification details about its workers, making it difficult for inspectors to verify their eligibility to work in the Netherlands.

The Labour Inspectorate stated that the restaurant had not made enough effort to improve its compliance with the rules, and in order to prevent further violations, it ordered the closure of the restaurant for one month.

Fat Kee, which has been operating for about 20 years, now faces sanctions for violating the Foreign Nationals Employment Act.

Work Permits for Chinese Nationals in the Netherlands

Chinese nationals wishing to work legally in the Netherlands are required to apply for a work permit, which can be a Tewerkstellingsvergunning (TWV), a Seasonal Work Permit, or a Highly Skilled Migrant permit, depending on their job. The Netherlands has been experiencing labour shortages and is seeking to attract foreign workers to address this issue. According to the UWV, work permit applications increased significantly in the first half of 2024, with 18,800 applications received.
